Definitions are Vital
Amongst the items stolen from a house in Chelsea was a quantity of silver – candelabra, picture frames and cutlery, totaling about £18,000. Additionally about £10,000 worth of Silver Plate cutlery was stolen. In the policy, there was a maximum sum insured of £15,000 for "items of precious metal". Loss Adjusters said therefore that the total that Insurers were liable for in respect of both of these items was £15,000. We contended that Silver Plate was not a precious metal and therefore the silver plate cutlery fell outside the scope of "items of precious metal". It took several letters and some vigorous discussions before Insurers accepted that their policy wording was such that they had to concede. Our client therefore received £10,000 more than Insurers had originally thought they should pay.
